Holding Summary
A subcontractor who fails to timely file a mechanic's lien affidavit and provide statutory notice cannot recover from a property owner for breach of contract, express warranty, implied warranty, or DTPA violations where the subcontractor had no direct contractual relationship with the property owner.
A subcontractor must file a lien affidavit no later than the 15th day of the fourth calendar month.
